SAN DIEGO – An El Cajon man alleges he was injured in a fall on a vessel because his employer failed to provide fall protection.
Robert Ninteman filed a complaint on June 11 in the U.S. District Court for the Southern District of California against The Dutra Group over alleged violation of the Jones Act and the General Maritime Law.
According to the complaint, the plaintiff alleges that on Nov. 19, 2016, he suffered severe and disabling injuries when he fell from a certain scow down to the deck of the dredge EM1106 in navigable waters at Pier 9, Naval Base in San Diego Harbor. The plaintiff claims he fell while washing the said scow while under the course of scope of his employment with defendant.
The plaintiff holds The Dutra Group responsible because the defendant allegedly failed to provide plaintiff with fall protection and failed to train and instruct him and his co-employees on the proper use of fall protection.
The plaintiff requests a trial by jury and seeks judgment for general damages, costs of suit, and for such other and further relief as the court may deem proper. He is represented by Preston Easley and Peter Yovanovich of Law Offices of Preston Easley APC in San Pedro.
