Woman alleges NutriBullet Rx blender caused burns

LOS ANGELES – A Virginia woman alleges she was burned when making a smoothie because of a defect in the blender she was using.

Marie Jenkins filed a complaint on June 18 in the U.S. District Court for the Central District of California against Nutribullet LLC, Capital Brands LLC, Homeland Housewares LLC, Call to Action LLC, Nutriviling LLC and Does 1 through 10 alleging negligence and strict liability.

According to the complaint, the plaintiff alleges that on July 14, 2016, she was using defendants' NutriBullet Rx blender to prepare a fruit and vegetable smoothie. The suit states when she unscrewed the blade assembly from the canister, the canister projected away from her and its contents erupted all over her body, causing serious burn injuries. The suit states the ingredients of the smoothie were refrigerated up until she used the blender.

The plaintiff alleges the defendants manufactured a blender with a defect that causes an explosion from the over-pressurization of the canister.

The plaintiff requests a trial by jury and seeks judgment for punitive and exemplary damages, costs, attorneys' fees, costs of suit, and such other and further relief as the court deems just and proper.
