San Joaquin property interest owners seek declaration over allegedly unenforceable lease

FRESNO – Two plaintiffs with an interest in a San Joaquin property allege a lease was executed on it without their consent.

Jacki Driver and the estate of Mary Ann Kozera filed a complaint on July 9 in the Fresno County Superior Court against Donna Rusconi Johnson, Andrew Groppetti and Does 1 through 10 alleging unjust enrichment.

According to the complaint, the plaintiffs and Johnson own interests in San Joaquin property. The suit states Groppetti has paid for the use of the property for two years and Johnson has retained the payments without paying a proportionate share to the plaintiffs. The plaintiffs allege this alleged lease was executed without their approval and that it is unenforceable.

The plaintiffs seek declaration that they can list and sell the property unencumbered by the alleged lease, monetary damages, costs of suit, and for such other and further relief as the court may deem proper.
