LOS ANGELES – A Texas couple who owns a vacation home in Malibu, California allege the owners of a neighboring property have built unlawful structures that extend onto their property.
David James Sacks and Deana Pollard Sacks filed a complaint on July 19 in the U.S. District Court for the Central District of California against Richard and Saloi Knickerbocker alleging trespass to land, nuisance and other counts.
According to the complaint, the plaintiffs own the property at 26608 Ocean View Drive in Malibu and the defendants have a neighboring property. The suit states the defendants have built a deck that is on the plaintiffs' property and after the plaintiffs had the property surveyed in June and marked, the defendants excavated a portion of the plaintiffs' property, removed a survey monument and removed the property markers.
The plaintiffs hold Richard and Saloi Knickerbocker responsible because the defendants allegedly have unpermitted structures that violate setbacks and are otherwise unlawful and that the structures allegedly have attracted files and rodents.
The plaintiffs request a trial by jury and seek judgment against defendants for compensatory, punitive and treble damages; interest; attorney's fees; injunctive relief; costs of suit and other relief the court deems just.
