Garner Trucking sued for $100,000, after cargo allegedly spills on Highway 99, causing crash

FRESNO — A Honda driver is suing Garner Trucking for $100,000, claiming that a Freightliner spilled its contents on Highway 99, causing an accident with serious injuries.

Javier Macias filed the complaint on July 10, in Fresno County Superior Court, against Garner Trucking Inc., driver Arvin Anthony Krause and Does 1-20, alleging that the defendants were responsible for his injuries. 

The lawsuit claims that the truck's contents were not secured and that the truck was not operated in a safe manner. 

Macias alleges that on Nov. 15, 2017, he was driving his 2007 Honda Civic south on Highway 99, when his vehicle hit cargo that had fallen from a Freightliner owned by Garner Trucking. The cargo was blocking his lane of travel, according to the lawsuit.

Krause was driving the Freightliner when the accident allegedly happened. Macias was seriously injured and incurred medical costs.

The plaintiff requests a trial by jury and seeks judgment for general damages in the amount of $100,000 for medical and incidental expenses, loss of earnings, costs of suit, and for such other and further relief as the court deems just and proper.
