Deerpoint Group alleges tank not built according to purchase agreement

FRESNO – A Fresno County company is alleged to have failed to construct a steel reactor tank according to a purchase agreement.

Deerpoint Group Inc. filed a complaint on July 12 in the Fresno County Superior Court against Central Valley Tank of California Inc. and Does 1-20 alleging breach of contract and other counts.

According to the complaint, the parties entered into negotiations in 2017 for the defendant construct a stainless steel reactor tank for the plaintiff's Madera facility. The suit states the reactor tank was delivered Feb. 22, and the plaintiff has had issues with the tank.

The plaintiff holds Central Valley Tank of California Inc., and Does 1-20 responsible because the defendants allegedly failed to design and manufacture a reactor that would match the description according to purchase agreement.

The plaintiff requests a trial by jury and seeks judgment against defendant for general and punitive damages, interest and further relief as the court deems just. It is represented by David R. McNamara of McCormick, Barstow, Sheppard, Wayte & Carruth LLP in Fresno.
