Wheelchair user alleges he encountered barriers at Hawthorne restaurant

LOS ANGELES – A Hawthorne restaurant is alleged to have failed to maintain the parking space for customers with disabilities.

Andres Gomez filed a complaint on July 30 in the U.S. District Court for the Central District of California against Sal Lopez, doing business as Mandy's Family Restaurant, and Does 1-10 alleging violation of the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff alleges that on March 30 and May 21, he was discriminated and sustained difficulty while attempting to utilize the parking facility of the defendants' restaurant located at 13510 Inglewood Ave., Hawthorne. The suit states the plaintiff uses a wheelchair for mobility.

The plaintiff holds Lopez, doing business as Mandy's Family Restaurant, and Does 1-10 responsible because the defendant allegedly failed to properly maintain the access aisles and parking area of the parking space designed for persons with disabilities and failed to mark the space with the International Symbol of Accessibility.

The plaintiff requests a trial by jury and seeks judgment against defendants for preliminary and permanent injunction; award of statutory, general and treble damages; restitution; attorney’s fees; litigation expenses; costs of suit; interest; and further relief as the court deems just. He is represented by Jason Yoon, John Y. Kim and Jason J. Kim of So. Cal. Equal Access Group in Los Angeles.
