Injured woman alleges Fresno County failed to place guardrails on side of road

FRESNO – A woman injured when the vehicle she was in went off of a Fresno County road alleges the county was negligent by not putting up guardrails.

Tabitha Rathbun filed a complaint on Aug. 3 in the Fresno County Superior Court against the county of Fresno and Does 1 to 50 alleging negligence and dangerous condition of public property.

According to the complaint, on Aug. 13, 2017, while lawfully on Auberry Roadway, Rathbun claims the vehicle she was riding in exited the roadway towards the west and careened into the ditch, causing injury.

The plaintiff holds the county of Fresno responsible because the defendant allegedly failed to place a guardrail on the west side of the road, failed to provide proper pavement markings, failed to fill in the depression/valley to the west of the road and failed to warn of the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment for general damages, medical expenses, loss of earnings, costs of suit, and for such other and further relief as this court may deem proper. She is represented by Daniel G. Sheldon of Scolinos, Sheldon & Nevell in Pasadena.
