Fresno consumer alleges General Motors vehicle has engine defects

FRESNO – A Fresno consumer is seeking a rescission of the purchase contract of a General Motors vehicle he alleges has engine defects.

Luis A. Zapien-Peinado filed a complaint on Aug. 2 in the Fresno County Superior Court against General Motors LLC and Does 1-10 alleging violation of the Song-Beverly Act.

According to the complaint, the plaintiff alleges that on Aug. 13, 2015, he purchased a new 2015 GMC Sierra Crew that was delivered to him with serious defects and nonconformities to warranty, including engine defects. 

The plaintiff holds General Motors LLC and Does 1-10 responsible because the nonconformities allegedly impaired the use, value and/or safety of the vehicle and the defendants allegedly failed to either promptly replace or repair the defective vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendants for general, special and actual damages; rescission; diminution in value; incidental and consequential damages; civil penalty; interest; attorney's fees; costs of suit; and further relief as the court deems just.
