Consumer alleges Chevrolet vehicle she purchased in 2012 has defects, seeks replacement

FRESNO – A Clovis resident alleges a vehicle she purchased nearly six years ago has defects and seeks either replacement or restitution.

Joycelene Gonzalez filed a complaint on Aug. 9 in the Fresno County Superior Court against General Motors LLC and Does 1-10 alleging breach of implied warranty and breach of express warranty.

According to the complaint, the plaintiff alleges that on Sept. 6, 2012, she paid $27,359.36 for the purchase of a new 2012 Chevrolet Cruze with warranty that the vehicle and all its components would be free from defects in material and workmanship. 

She alleges the vehicle was delivered to her with serious defects and nonconformities to warranty and that the vehicle developed other serious defects that persisted even after several repair attempts. She alleges these defects include fluid leaks and issues with the power steering and cooling systems.

The plaintiff holds General Motors LLC and Does 1-10 responsible because the defendant allegedly failed to conform the vehicle to the applicable warranties.

The plaintiff requests a trial by jury and seeks judgment against all defendants, replacement or restitution, incidental and consequential damages, attorney's fees, costs of suit and expenses, prejudgment interest, and other relief as the court deems appropriate. She is represented by David A. Goldsmith of Goldsmith West in Los Angeles.
