FRESNO – A maintenance worker alleges that his former employers timekeeping procedures did not accurately track all the hours he worked.
Andrew Romero filed a complaint on Aug. 9 in the Fresno County Superior Court against Westco Equities Inc. and Does 1-50 alleging violation of California labor codes.
According to the complaint, the plaintiff alleges that beginning July 1, 2014, he was working for defendants' investment property management company as a maintenance worker performing various tasks. He alleges he was denied overtime wages and proper meal and rest periods, and was also required to provide his own tools and his own vehicle to travel between work order sites and the upkeep and replacement costs of tools.
The plaintiff holds Westco Equities Inc. and Does 1-50 responsible because the defendants allegedly failed to compensate its employees for time spent preparing to travel and traveling to job sites, failed to fully pay plaintiff for all minimum and overtime wages, and failed to keep or provide an accurate record of its employees' hours worked.
The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory, actual and liquidated damages; expenses; attorneys’ fees and cost of suit; penalty; interest; and further relief as the court deems just.
