FRESNO – A Fresno County construction company is alleged to have failed to provide the kilowatt reduction contracted in a solar panel project.
Shiralian Enterprises Inc. filed a complaint on Aug. 9 in the Fresno County Superior Court against Richard Herzog Construction Inc. and Does 1-50 alleging negligence, breach of contract and other counts.
According to the complaint, the plaintiff requested bids for the installation of solar panels and for commercial lighting upgrades at its Bakersfield building. The suit states a bid was accepted from the defendant on April 10, 2015.
The plaintiff alleges it did not receive the promise rate of return from the solar panels installed by the defendant.
The plaintiff holds Richard Herzog Construction Inc. and Does 1-50 responsible because the defendants allegedly failed to act reasonably under the contract and charged plaintiff an extra $153,283 for the same performance of work and failed to provide the kilowatt reduction contracted.
The plaintiff seeks judgment against defendant for special and monetary damages in the amount of $153,283, equitable relief, restitution, interest, costs of suit, and other relief to which the court deems appropriate.
