FRESNO – A patient alleges he was injured at a Fresno medical facility and while en route in an ambulance to Clovis Community Medical Center.
Nicholas R. Merlo, by and through his conservator and guardian ad litem, Kaci K. Merlo, individually filed a complaint on Aug. 13 in the Fayette Circuit Court against Pristine Surgery Center Inc., et al. alleging medical malpractice.
According to the complaint, the plaintiffs allege that on March 14, Nicholas R. Merlo consulted with defendants, was examined and underwent an endoscopy, intubation, resuscitation and transport, and other diagnostic and therapeutic procedures.
The plaintiffs hold Pristine Surgery Center Inc., et al. responsible because the defendant allegedly "failed to use reasonable care or skill common to medical, CRNA and ambulance practitioners in the community and failed to use reasonable care in the diagnosis and treatment of patient's condition, illness and injury," the suit states.
Kari Merlo alleges she suffered a loss of consortium of her husband.
The plaintiffs seek judgment for compensatory damages according to proof. They are represented by Daniel R. Baradat of Baradat & Paboojian Inc. in Fresno.
