FRESNO – A couple has filed suit against their insurers over uninsured motorist coverage for a vehicle that was covered under a policy.

David Erickson and Cynthia Erickson filed a complaint on Aug. 16 in the Fresno County Superior Court against The Travelers Indemnity Co., The Standard Fire Insurance Co. and Does 1 to 25 alleging tortious breach of insurance contract and bad faith.

According to the complaint, the plaintiffs made a claim for coverage from the defendants after their son was involved in a motor vehicle accident in 2016 while operating an insured 1990 Chevrolet Silverado. The suit states the accident was caused by an uninsured motorist who failed to stop for a red light at a Fresno County intersection.

The plaintiffs hold The Travelers Indemnity Co., The Standard Fire Insurance Co. and Does 1 to 25 responsible because the defendants allegedly acted in bad faith when they wrongfully denied the plaintiffs' claim for uninsured motorist coverage.

The plaintiffs seek declaration that they are entitled to recover damages sustained to their insured vehicle, judgment for general damages in an amount not exceeding $75,000, plus interest, attorney's fees, costs of suit, and for such other and further relief as the court deems just and proper. They are represented by Robert G. Williams and Maria G. Cordova of Perez, Williams, Medina & Rodriguez LLP in Fresno.
