Landlord of Fresno apartments alleged to have issued notices to vacate after tenants complained of issues

FRESNO – Tenants of Fresno apartment units allege their landlord retaliated against them after they reported housing issues to the city.

Cynthia Morency, Thomas Yearton, Erica Torrez and Alfonso Pacheco filed a complaint on Aug. 17 in the Fresno County Superior Court against Kirk Christensen and Does 1-25 alleging breach of warranty of habitability, negligence and other counts.

According to the complaint, the plaintiffs complained to the city of Fresno about the much-needed repairs and housing issues in the apartments they rent from Christensen. They allege prior to making this complaint with the city, they had requested the defendant to make repairs both orally and in writing and that he either ignored them or failed to ensure the repairs were done correctly.

The plaintiffs allege the defendant was issued a notice of violation from the city June 1 and he retaliated against them by issuing notices to terminate their vacancies.

The plaintiffs hold Christensen responsible because the defendant allegedly failed to correct substandard conditions.

The plaintiffs request a trial by jury and seek judgment for damages, pre- and post-judgment interest, costs of suit, and for any further relief the court deems appropriate and just. They are represented by Pahoua C. Lor of Law Office of Pahoua C. Lor in Fresno.
