Employee files lawsuit against Betts Co., alleging unpaid wages

FRESNO — A non-exempt employee has filed a class-action lawsuit against a California corporation, citing alleged breach of employment contract and unpaid wages.

Joseph Mar, individually, and on behalf of other members of the general public similarly situated filed a complaint on Aug. 20, in the Fresno County Superior Court against Betts Co.; and Does 1 through 100 for allegedly violating the California Labor Code and the Industrial Welfare Commission Wage Order.

According to the complaint, between April 2015 and Sept. 2016, Joseph Mar was hired as an hourly, non-exempt employee by defendant but claims he and the other class members were allegedly not compensated for all hours works and missed meal period and/or rest breaks despite working eight hours in a day and for 40 hours a week. 

The plaintiff holds Betts Co. responsible because the defendant allegedly failed to compensate employees at a rate of pay either time-and-one-half or two times the regular rate of pay, defending on the number of hours worked by the person on a daily or weekly basis.

The plaintiff requests a trial by jury and seeks judgment for actual, consequential and incidental losses and damages, attorneys' fees, costs incurred, injunctive relief, and such other and further relief as the Court may deem just and proper.
