Former Producers Dairy Foods driver alleges he was not given uninterrupted rest breaks

FRESNO – A Central Valley dairy is alleged to have failed to provide uninterrupted rest breaks to a former driver.

Theodore Kerber filed a complaint on Aug. 23 in the Fresno County Superior Court against Producers Dairy Foods Inc. and Does 1-100 alleging violation of California labor codes.

According to the complaint, the plaintiff was employed as a driver for Producers Dairy Foods from 2008 to October 2017. He alleges he was not provided uninterrupted 10-minute rest breaks, meal breaks of at least 30 minutes and accurate, itemized wage statements.

The plaintiff holds Producers Dairy Foods Inc. and Does 1-100 responsible because the defendants allegedly failed to consistently provide uninterrupted and unrestricted meal periods within the first 5 hours of work, failed to provide uninterrupted rest periods to its non-exempt personnel.

The plaintiff requests a trial by jury and seeks judgment against defendants for general and compensatory damages, penalties, attorney fees, costs of suit, prejudgment interest, and further relief as the court may deem just.
