SAN DIEGO – The U.S. Equal Employment Opportunity Commission alleges that a Riverside County-based business engages in a pattern of hiring predominately females over males for server positions.

U.S. Equal Employment Opportunity Commission filed a complaint on Aug. 28 in the U.S. District Court for the Southern District of California against the Honold Enterprises Inc., doing business as Burgers & Beer, et al. alleging employment discrimination.

According to the complaint, on March 9, the plaintiff issued to the defendants a letter of determination finding reasonable cause to believe that they violated Title VII when they denied a promotion, hire and/or transfer into an open server position Nickolas Madrid based on his sex. The plaintiff also alleges the defendants did not keep payroll records and other relevant records.

The plaintiff alleges they engaged with the defendants to provide them an opportunity to remedy the issues but conciliation was not reached.

The plaintiff requests a trial by jury and seeks permanent injunction enjoining defendants from engaging in any employment discriminatory practices, an order for defendants to provide compensation to the aggrieved individuals and award for costs and such other necessary and proper relief. It is represented by Anna Y. Park, Sue J. Noh and Rumduol Vuong of the EEOC in Los Angeles.
