Customer claims Los Angeles liquor store's parking lot has barriers to disabled individuals

LOS ANGELES – A wheelchair user alleges that a Los Angeles liquor store and grocery market failed to maintain a parking space designated for persons with disabilities.

Allen Ferguson filed a complaint on Sept. 4 in the U.S. District Court for the Central District of California against BJ Investment Inc., doing business as Harry's Liquor Store, and Does 1 through 10 over alleged violation of the American with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, on May 25 and July 10, Ferguson went to the defendant's store and allegedly personally encountered a number of barriers that interfered with his ability to use and enjoy the goods, services, privileges, and accommodations offered at the business. 

The plaintiff alleges the defendants have not removed the barriers and have not modified the business to conform to disability accessibility regulations. 

The plaintiff holds BJ Investment Inc. and Does 1 to 10 responsible because the defendant allegedly failed to comply with the federal and state standards for the parking space designated for persons with disabilities.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction, award appropriate damages, attorney's fees, litigation expenses, costs of suit, prejudgment interest, and such other and further relief as the court deems just and proper. He is represented by Jason Yoon, John Y. Kim and Jason J. Kim of So. Cal. Equal Access Group in Los Angeles.
