LOS ANGELES – A Los Angeles County consumer alleges a debt collector harassed her with multiple calls to her cellphone on a daily basis.
Shantwania Dickson filed a complaint on Sept. 5 in the U.S. District Court for the Central District of California against Wells Fargo Bank NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges the defendant has called her 75 times since March to collect an alleged debt. She alleges she sent written correspondence asking the defendant to stop calling her but the calls have continued.
The plaintiff holds Wells Fargo Bank NA responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.
The plaintiff requests a trial by jury and seeks judgment against defendant for award of actual and statutory damages, costs of litigation and attorney’s fees, and all other relief that the court deems just.
