SAN DIEGO – An Arizona resident is alleged to have hit a minor at the Gordon Wells sand dunes and fled the scene.

Jake Cabral, a minor by and through his guardian ad litem, Richard Cabral, filed a complaint on Sept. 10 in the U.S. District Court for the Southern District of California against Renee Wills Denney alleging negligence.

According to the complaint, on Nov. 24, 2017, minor plaintiff Jake Cabral was riding a dirt bike at the Gordon Wells sand dunes in Imperial County when he was struck by the defendant's four-wheel, off-road vehicle, causing injuries and damage to his bike. The suit states Denney fled the scene and Cabral had to be transported by helicopter for medical treatment.

The suit states Jake Cabral sustained fractured ribs, a fractured pelvis and spine and other injuries.

The plaintiff holds Denney responsible because the defendant allegedly failed to exercise reasonable care in operating her off-road vehicle.

The plaintiff requests a trial by jury and seeks judgment for general and special damages, loss of impairment, prejudgment interest, costs of action and for such other relief the court may deem just and proper. He is represented by John F. McGuire Jr. of Thorsnes Bartolotta McGuire LLP in San Diego.
