Basketball that struck sprinkler head at San Diego property alleged to have caused $700,000 in property damage

SAN DIEGO – A sprinkler head in an apartment building that was purportedly broken by tenants playing with a basketball is alleged to have caused more than $700,000 in property damage.

Curtain Underwriters at Lloyd's, London, as subrogee of Trinity Property Consultants, filed a complaint on Sept. 11 in the U.S. District Court for the Southern District of California against Jackson Meuter, Mike Meuter, Jevon Carriaga and Kimberly Carriaga alleging negligence and breach of contract.

According to the complaint, on Aug. 27, 2017, plaintiff's subrogor's property in San Diego was damaged due to water that was suddenly released from a sprinkler head. The suit states that Jackson Meuter and Jevon Carriaga, tenants at the property, were playing with a basketball in the hallway that struck and broke a sprinkler head.

The suit states the defendants breached their leases by negligently causing the water and damage. The plaintiff alleges it paid the claims submitted by Trinity Property Consultants and is seeking subrogation.

The plaintiff requests a trial by jury and seeks judgment in an amount of more than $700,000, plus costs of suit, delay damages, attorney fees, and for such other relief as the court shall deem appropriate under the circumstances. It is represented by Susan M. Benson of Benson Legal APC in Encino.
