McDonald's customer alleges injuries after item hit her head

FRESNO – A customer at a fast food restaurant in Sanger alleges she was injured when a container fell and hit her head.

Leslie Sustaita filed a complaint on Sept. 5 in the Fresno County Superior Court against B&M Story LLC and Does 1 to 10 citing premises liability and negligence.

According to the complaint, on Sept. 7, 2016, the plaintiff was lawfully present at the defendant's McDonald's restaurant in Sanger when a large container or lid above the fountain drinks allegedly fell and hit her head. 

As a result, Sustaita claims she sustained economic and non-economic damages. 

The plaintiff holds B&M Story LLC responsible because the defendant allegedly negligently hired and trained its agents in looking for and correcting or warning of items that could fall and injure customers.

The plaintiff seeks compensatory damages according to proof. She is represented by Joseph S. Farzam of Joseph Farzam Law Firm in Los Angeles.
