Wrongful death suit filed against Saint Agnes Medical Center, others

FRESNO – A widow and parent have filed a wrongful death suit against several medical entities after their decedent died after being struck by a vehicle.

Sandee Morelion and Rosie Strickland filed a complaint on Sept. 10 in the Fresno County Superior Court against Saint Agnes Medical Center, Trinity Health, et al. alleging gross negligence, wrongful death, fraud and other counts.

According to the complaint, the plaintiffs' decedent Richard Viviano-Morelion sought care at the Saint Agnes Medical Center emergency room multiple times in 2016 in 2017. The suit states in March 2017, he was taken by ambulance to the hospital's emergency room for complaints of heart palpitations and later discharged while still "profoundly intoxicated." The suit states he later lay down in a roadway and was struck by a vehicle, which caused his death.

The plaintiffs hold Saint Agnes Medical Center, Trinity Health, et al. responsible because the defendants allegedly failed to comply with their duties under the standards of care.

The plaintiffs request a trial by jury and seek judgment against defendants for general, special and punitive damages; attorneys' fees; costs of suit; expert witness costs; interest; and further relief as the court my deem just.
