Former tenant of Blue Oak Property Management alleges black mold in apartment caused medical issues

OROVILLE – A former tenant of a Chico apartment alleges black mold in the unit caused medical issues with his lungs.

Joshua Lavergne filed a complaint on Oct. 3 in the Butte Superior Court against Michael Huber and Blue Oak Property Management alleging premises liability and personal injury.

According to the complaint, on April 16, the plaintiff moved into defendants' Chico apartment shortly afterward began showing signs of fatigue and trouble breathing. After numerous trips to the hospital and a lung specialist, an X-ray revealed a nodule in his lung. He alleges he was told black mold was the cause of his medical condition and he discovered mold in his apartment.

The suit states the plaintiff left the apartment and stayed in hotels until he secured another apartment.

The plaintiff holds Huber and Blue Oak Property Management responsible because the defendants allegedly failed to maintain a habitable environment in the apartment.

The plaintiff seeks compensatory damages according to proof. He is represented by Thomas P. Bleau of Bleau Fox in Burbank.
