CSAA Insurance Exchange seeks more than $30,000 over fire allegedly caused by sanitizer

OROVILLE – An insurance company is seeking subrogation for damages it paid over a fire allegedly caused by a pool/spa sanitizer.

CSAA Insurance Exchange filed a complaint on Sept. 24 in the Butte County Superior Court against Trident Group USA LTD; Paramount Leisure Industries Inc.; Gamma  Enterprises Inc., doing business as Holiday Pools Retail and Service;  and Does 1-20 alleging strict products liability, breach of warranty and other counts.

According to the complaint, the plaintiff represents its insured, Solveig Cooper, over damages sustained to the Cooper property located at 4258 Green Meadow Lane in Chico. The suit states in March 2017, an ultraviolet sanitizer at the Cooper property failed and caused a fire. The plaintiff alleges it paid more than $30,000 to Cooper under its policy.

The suit states Holiday Pools sold and installed the system, which was a Trident Series model that was manufactured by Paramount.

The plaintiff is seeking subrogation.

The plaintiff seeks judgment against defendants for the sum of $32,174.49, interest, costs of suit, and further relief as the court may deem just. It is represented by Robert E. Wall and Mark S. Sandberg of The Grunsky Law Firm PC in Watsonville.
