Consumer alleges Solar Mosaic, 1st Light misrepresented tax credit amount for installing system

STOCKTON – A San Joaquin County consumer alleges that companies in Oakland and Manteca misrepresented the amount he was to receive as a tax credit for installing a solar system.

Son Nguyen filed a complaint on Oct. 4 in the San Joaquin Superior Court against Solar Mosaic Inc., 1st Light Energy Inc., Pete Waters and Does 1-10 alleging intentional misrepresentation, fraud in the inducement and other counts.

According to the complaint, on Feb. 11, 2016, Nguyen entered into an agreement with 1st Light for the purchase and installation of a solar system. On Feb. 16, 2016, the suit states the plaintiff entered into an agreement with Solar Mosaic to finance the system.

The plaintiff alleges Waters, a consultant for the defendant companies, promised the plaintiff he would receive a tax credit in an approximate amount of $10,200 in the first year after entering into the agreements. 

However, on March 6, 2017, the plaintiff alleges he was advised by his tax professional that would, in fact, not receive a tax credit of $10,200 but instead would only receive the amount of only $1,709. He alleges he attempted to contact the defendants and was unable to speak to anyone directly, and he stopped making payments. The suit states that the defendants engaged a collection agency.

The plaintiff holds Solar Mosaic Inc., 1st Light Energy Inc., Waters and Does 1-10 responsible because the defendants allegedly intentionally misrepresented the amount of the tax credit with the intent to induce plaintiff to enter into the agreements under false pretenses.

The plaintiff seeks judgment for general, special, compensatory and consequential damages; rescission of the agreement; injunctive relief; attorney's fees; costs of suit incurred; and for such other and further relief as the court may deem proper. He is representing himself.
