American Zurich Insurance seeks to recover workers' comp payments from driver involved in collision with employee

FRESNO – An insurance company is seeking to recover damages from an individual over a collision that injured its employee.

American Zurich Insurance Co. filed a complaint on Oct. 1 in the Fresno County Superior Court against Lorenzo Frias III and Does 1-50 seeking to recover benefits.

According to the complaint, on Oct. 3, 2016, American Zurich Insurance's employee Anne Marie Duarte-Kausin was driving on Willow Avenue in Fresno when her vehicle was struck by the defendant.

The plaintiff holds Frias and Does 1-50 responsible because Frias allegedly negligently maintained, managed and controlled the vehicle so as to cause it to collide with its employee.

The plaintiff seeks judgment against the defendants for amounts it expended for workers' compensation benefits, costs of suit, general damages, interest, and further relief as to the court deems just. It is represented by Lawrence P. Perle of Law Offices of Steven B. Simon in Woodland Hills.
