Individual allegedly struck by commercial truck in Trader Joe's parking lot files suit for damages

STOCKTON – An individual is seeking damages from a driver and the owner of a commercial truck after he was allegedly struck in a grocery store parking lot.

Eric G. Gutierrez filed a complaint on Oct. 4 in the San Joaquin Superior Court against Gregory Flemmings, Penske Truck Leasing, Quality Driver Solutions Inc. and Penske Logistics LLC alleging negligence.

According to the complaint, on Dec. 11, 2016, Gutierrez was run over by defendant Penske Logistics' commercial truck while in the parking lot of Trader Joe's in Stockton. The suit states Flemmings was operating the vehicle in the scope of his employment with Quality Driver Solutions.

The plaintiff alleges he suffered a loss of wages, incurred hospital and medical expenses and loss of earning capacity as a result of the collision.

The plaintiff seeks judgment for compensatory damages in an amount of more than $25,000 and prejudgment interest. He is represented by Edward A. Smith of Law Offices of Edward A. Smith in Sacramento.
