San Francisco restaurant sued for breach of contract

SAN FRANCISCO — A wine distributor is suing a restaurant, citing alleged breach of contract.

Wine Warehouse filed a complaint on Oct. 3, in the San Francisco Superior Court, against Daniel Flores, doing business as Room Service Fine Food and Liquor, and Does 1-100, alleging that the defendant defaulted on payments.

According to the complaint, on July 16, 2013, parties executed and entered into a written agreement whereby plaintiff performed all of its obligation but claims the defendant defaulted on monthly payments on April 27, 2017. 

Plaintiff claims although demand has been made, no part of the payment amounting to $3,773.96 has allegedly been paid, together with an interest rate of 24 percent. 

The plaintiff claims the defendant allegedly defaulted under the terms of the contract by failing to pay money due.

The plaintiff requests a trial by jury and seeks judgement in the principal sum of $3,773.96 plus interest, with attorney's fees, costs of suit, and such other and further relief as the court may deem just and proper.
