Motorist sued for allegedly striking pedestrian

FRESNO — Damian Luna and Maria Luna filed a complaint on Oct. 1, in the Fresno County Superior Court, against Uchena Ezenwa Ezeokwelume for alleged violation of the California Vehicle Code. The couple claims that the defendant's vehicle struck Damian Luna.

According to the complaint, on Oct. 31, 2016, Damian Luna was standing on or near Polk Street when the defendant's vehicle allegedly hit him, causing him to strike the hood of the car and fall off. 

The incident was observed by a Coalinga police officer, who claimed the defendant fled the scene but was apprehended and detained by police officer Miguel Gomez. 

Maria Luna claims that as the result of his injuries, she has been deprived of the love and companionship of her husband. 

The plaintiffs hold Uchena Ezenwa Ezeokwelume responsible because the defendant allegedly negligently caused the accident.

The plaintiffs request a trial by jury and seek judgment for compensatory damages in the amount of $25,000, plus costs of suit, and such relief as is fair, just and equitable. They are represented by Glenda de Guzman of The Dunnion Law Firm in Monterey.
