Pedestrian sues city and county of San Francisco after allegedly tripping over fire hose

SAN FRANCISCO — A woman who claims she tripped over a hose attached to a fire hydrant is suing the city and county of San Francisco, citing negligence and vicarious liability.

Rosemary Nightingale filed a complaint on Oct. 3, in the San Francisco County Superior Court, against the defendants alleging that they failed to follow safety guidelines and regulations.

The plaintiff alleges that, on November 14, 2017, she was walking east on the sidewalk maintained by the defendants toward the Old Saint Mary's Cathedral on California Street, when she allegedly tripped over a water hose attached to a hydrant. 

As a result of the incident, plaintiff suffered serious and disabling injuries, physical pain, mental anguish and loss of income, according to the lawsuit. 

The plaintiff holds the city and county of San Francisco and Does 1-5 responsible because the defendants allegedly created a hazard, and failed to put up warning signs to notify pedestrians.

The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory general damages, costs of suit, interests, and other relief as the court may deem just. She is represented by Fulvio A. Picerno of Law Office of Fulvio A. Picerno in Newark.
