Farmers Specialty Insurance sues motorist over payments

SAN FRANCISCO — An insurance company is suing a motorist, citing alleged refusal to apply payments.

Farmers Specialty Insurance Co. filed a complaint on Oct. 10, in San Francisco Superior Court against Nadiyah Rajeeyah Shereff and Does 1 through 5, alleging that the defendant breached his duty to provide subrogation claims to plaintiff after a vehicle collision.

According to the complaint, Farmers Specialty Insurance Co. issued an automobile insurance claim to its insured after a vehicle collision on Dec. 17, 2015, allegedly caused by the defendant. 

Plaintiff claims it provided $18,278.67 pursuant to the insurance policy and thereby is entitled to be paid as subrogation. 

The plaintiff holds Nadiyah Rajeeyah Shereff responsible because the defendant allegedly failed to pay plaintiff the full amount of the damages sustained by the insured.

The plaintiff requests a trial by jury and seeks judgment for damages in the sum of $18,278.67, plus costs of suit, interest at the legal rate and for such other and further relief as the Court deems just and proper. The plaintiff is represented by Susan M. Benson of Benson Legal, APC in Encino.
