Oak River Insurance seeks subrogation from trucking company for workers' compensation claim

FRESNO – An insurance company is seeking compensation from a trucking company and its driver for a workers' compensation claim it paid on behalf of an injured driver.

Oak River Insurance Co., administered by Berkshire Hathaway Homestate Cos., filed a complaint on Oct. 9 in the Fresno County Superior Court against Agustin Hernandez-Sanchez, HH Trucking LLC and Does 1-20 seeking reimbursement of workers' compensation benefits.

According to the complaint, on Oct. 13, 2016, Oak River Insurance Co. was the workers' compensation insurance carrier for Transmission Supply Corp. when its employee suffered a collision with defendants' vehicle in Fresno. 

The plaintiff alleges it provided workers' compensation claims under the terms of the insurance policy is now seeking to be reimbursed for the payments made as subrogation. 

The plaintiff seeks judgment for all medical expenses it paid, compensation benefits paid, costs of suit, interest, attorney fees, and for such other and further relief as the court deems just and proper. It is represented by Gregory F. Johnsen of Law Offices of Gregory F. Johnsen in Sherman Oaks.
