Man alleges information on tenant screening report from On-Site was inaccurate

SAN FRANCISCO – An applicant to an affordable housing community in Richmond alleges he was determined to be ineligible because of an inaccurate tenant screening report.

Chauncey George filed a complaint on Oct. 12 in the San Francisco County Superior Court against On-Site, RealPage Inc. and Does 1-10 citing the Consumer Credit Reporting Agencies Act and the Investigative Consumer Reporting Agencies Act.

According to the complaint, the plaintiff applied for rental housing at an affordable housing community in Richmond in 2016. He alleges the community determined he was ineligible because of a tenant screening report obtained from On-Site that inaccurately stated he had been convicted of three misdemeanors six months' prior. He alleges he disputed the error with On-Site, but it did not respond.

The plaintiff holds On-Site, RealPage Inc. and Does 1-10 responsible because the defendants allegedly failed to accurately report criminal records information.

The plaintiff requests a trial by jury and seeks judgment against defendants for statutory damages of $10,000 per violation, punitive damages, declaratory and injunctive relief, costs of suit, attorneys' fees, interest, and further relief as the court deems just. He is represented by Kari A. Rudd and Juliana Fredman of Bay Area Legal Aid in San Francisco and Craig Davis of Law Offices of Craig Davis in San Francisco.
