Attorney alleges landlord wrongfully evicted him from San Francisco residence

SAN FRANCISCO – An attorney alleges his landlord failed to move into the residence after notifying him to leave it.

Fernando Vargas filed a complaint on Oct. 12 in the San Francisco County Superior Court against Sandra Thomas and Does 1-25 alleging wrongful eviction and fraudulent misrepresentation.

According to the complaint, the plaintiff was a tenant at the defendant's residential building in Fulton Street in San Francisco and paid $1,900 a month in rent. He alleges that on Nov. 1, 2017, he was forced to vacate the rented premises because the defendant notified him she intended to move into the residence. The plaintiff alleges the defendant failed to move into the property within three months of recovering possession.

The plaintiff holds Thomas and Does 1-25 responsible because the defendants allegedly made representations with the intent to defraud him and induce him into wrongfully quitting the premises.

The plaintiff seeks judgment against defendants for damages in the sum of $29,700, punitive damages, attorney's fees, costs of suit, interest, and further relief as the court deems just. He represents himself and is with the Law Office of Fernando E. Vargas in San Francisco.
