SAN FRANCISCO – Several individuals allege their use of an herbicide caused them to develop cancer.

Kenneth W. Broadhurst, Alfredo Crespo, at al. filed a complaint on Oct. 11 in the San Francisco County Superior Court against Monsanto Co., Wilbur-Ellis Co. LLC, Wilbur-Ellis Feed LLC and Does 1-100 alleging negligence, fraud, strict liability - design defect and other counts.

According to the complaint, the plaintiffs allege that they or their decedents were diagnosed with non-Hodgkin lymphoma as a result of their exposure to Monsanto's herbicide Roundup and or other glyphosate-containing herbicide products. The suit states Roundup was sold and distributed by Wilbur-Ellis.

The plaintiffs hold Monsanto Co., Wilbur-Ellis Co. LLC, Wilbur-Ellis Feed LLC and Does 1-100 responsible because the defendants allegedly failed to prevent or adequately warn of the risks and injuries from Roundup use.

The plaintiffs request a trial by jury and seek judgment against defendants for actual or compensatory damages, exemplary and punitive damages, interest, costs, attorney's fees, court costs, litigation expenses, and other relief the court may deem just.

They are represented by Pedram Esfandiary, Michael L. Baum, R. Brent Wisner and Frances M. Phares of Baum Hedlund Aristei & Goldman PC in Los Angeles and Robert F. Kennedy Jr. and Kevin J. Madonna of Kennedy & Madonna LLP in Hurley, New York.
