BBJ Electric alleges it is still owed more than $81,000 for project work

SAN FRANCISCO – A San Francisco electrical contractor alleges it wasn't paid in full for work on a project.

BBJ Electric Inc. filed a complaint on Nov. 5 in the San Francisco Superior Court against Yerba Buena Engineering & Construction Inc., state of California Department of Transportation and Does 1 through 20 alleging breach of contract and other counts.

According to the complaint, in February, BBJ entered into a contract with Yerba Buena to provide electrical systems for a highway project. The plaintiff alleges it completed all work by June 15 and performed all of its obligations under the contract.

However, despite sending progress invoices for its work on the project, Yerba Buena Engineering & Construction allegedly failed to pay the plaintiff in full.

The plaintiff holds Yerba Buena Engineering & Construction Inc., state of California Department of Transportation and Does 1 through 20 responsible because Yerba Buena allegedly failed to pay the full amount due on five invoices, leaving a balance of $81,859.31.

The plaintiff seeks judgment for the final payment of $81,859.31 with interest, plus costs of suit, and for such other and further relief as the court deems just and proper. It is represented by Richard M. Kelly and Michael Mengarelli of Kelly Litigation Group Inc. in Redwood City.
