Brother of Fresno County woman files suit over distribution of settlement funds

FRESNO – A man alleges his Fresno County-residing sister falsified his signature on documents relating to a wrongful death suit.

Juan Leon filed a complaint on Oct. 31 in the Fresno County Superior Court against Josephine Leon alleging fraud and other counts.

According to the complaint, the plaintiff and defendant hired a lawyer to represent them in a wrongful death case over their mother's death and settled the case for $125,000. The suit states the lawyer distributed the settlement money to the defendant and she received $66,462.22.

The plaintiff alleges the defendant falsified his name on settlement documents and he did not know about the money until his sister received it. He alleges she has only offered $1,000 of the settlement funds to him instead of diving it between him and their brothers.

The plaintiff holds Leon and Does 1-100 responsible because the defendant allegedly concealed facts to defraud him.

The plaintiff seeks judgment against defendant for general, special and punitive damages; statutory costs; interest; attorney's fees; and further relief as the court deems just. He is represented by Monrae L. English of Wild, Carter & Tipton in Fresno.
