SAN FRANCISCO – Patrons of a Valenica Street, San Francisco business allege that the condition of the stairway at the premises caused injuries to a woman while attending a performance.
Hope Jacobson and Patrick Jacobson filed a complaint on Nov. 7 in the San Francisco Superior Court against Zaels & Plissken LLC, doing business as Elbo Room; and Does 1-20 alleging negligence and other counts.
According to the complaint, on Oct. 29, 2017, the plaintiffs attended a live musical performance that was open to the public on the second floor of the defendant's premises.
The suit states while the plaintiffs were making their way to the first floor via the stairway, plaintiff Hope Jacobson slipped, fell and landed on the floor of the bottom of the stairway, hitting her right hip, arm and right side of her head. The fall was allegedly due to the damaged, dilapidated and otherwise hazardous condition of the stairway.
The plaintiffs hold Zaels & Plissken LLC responsible because the defendant allegedly failed to ensure the stairway was in good, safe condition.
The plaintiffs seek judgment for general and special damages, costs of suit, and such other and further relief as the court deems just and proper. They are represented by Jonathan Joiner and Benjamin Humphreys of Humphreys Joiner Law Group LLP in San Francisco.
