SAN FRANCISCO – The former tenants of a San Francisco property allege they were wrongfully evicted.
Epifanio Jose Venegas, Eva Pilar Venegas and Rosa Maria Venegas filed a complaint on Nov. 7 in the San Francisco Superior Court against Anshuman S. Nadkarni and Renuka A. Nadkarni, individually and as trustees of Nadkarni Trust, and Does 1 through 10 alleging negligence, wrongful eviction and other counts.
According to the complaint, the plaintiffs were tenants of a Judah Street, San Francisco property from December 2008 to April 2018, which is owned by the Nadkarnis. They allege the defendants asked Rosa Maria Venegas if the plaintiffs would take a buyout of their tenancy, which they declined. The suit states the defendant then served the plaintiffs with a notice of vacancy in March that stated the defendants would be moving into the property. The plaintiffs allege the defendants never moved into the property after they vacated it in April.
The plaintiffs holds Anshuman S. Nadkarni and Renuka A. Nadkarni, individually and as trustees of Nadkarni Trust, and Does 1 through 10 responsible because the defendants allegedly served an owner-move-in eviction without any intention to move into the subject unit, failed to offer to re-rent the unit to plaintiffs once they did not move into unit and failed to file Notice of Termination of Tenancy at the San Francisco Rent Board.
The plaintiffs request a trial by jury and seek declaratory and injunctive relief, damages, prejudgment interest, attorney fees, and for such other and further relief as the court may deem just and proper.
