SAN FRANCISCO – A woman alleges her insurer wrongfully terminated her claim for disability benefits.

Michelle Kelman filed a complaint on Nov. 8 in the San Francisco County Superior Court against Berkshire Life Insurance Co. of America, Guardian Life Insurance Co. of America and Does 1-10 alleging breach of contract.

According to the complaint, the plaintiff became disabled in October 2016 and filed a claim for disability benefits with the defendant. The suit states in September 2017, the defendant denied her claim for benefits.

The plaintiff holds Berkshire Life Insurance Co. of America, Guardian Life Insurance Co. of America and Does 1-10 responsible because the defendants allegedly unreasonably and wrongfully failed to conduct a proper and/or timely investigation and review of her claim before refusing payment.

The plaintiff seeks judgment against the defendants for benefits, declaratory and injunctive relief, interest, restitution, attorney's fees, costs and expenses and other relief as the court deems just. She is represented by Scott Kalkin and William Reilly of Roboostoff & Kalkin in San Francisco.
