Agri Center Auto Parts mechanic alleges company failed to pay minimum wage

FRESNO – A mechanic has filed a suit against his employer over allegations it violated state labor codes.

Saenalai Inmany, an individual and as proxy for the California Labor and Workforce Development Agency, filed a complaint on Nov. 7 in the Fresno County Superior Court against Agri Center Auto Parts Inc. and Does 1-100 over alleged violation of California labor codes and the California Fair Employment and Housing Act.

According to the complaint, on Nov. 2, 2015, the plaintiff was hired by the defendant as non-exempt, hourly mechanic.

The plaintiff holds Agri Center Auto Parts Inc. responsible because the defendant allegedly failed to pay plaintiff and the class at least minimum wage for all hours worked and the appropriate rate for overtime hours, and failed to provide with meal and/or rest breaks as required by the labor code.

The plaintiff requests a trial by jury and seeks judgment for damages, penalties, injunctive relief, attorneys' fees, pre- and post-judgment interest, and for such other and further relief as the court deems just and proper. He is represented by William J. Gorham and Vladimir J. Kozina of Mayall Hurley PC in Stockton.
