Newstar Fresh Foods alleged to owe more than $110,000 for products

FRESNO – A Fresno County corporation is alleged to have failed to pay for products purchased in full.

Smart Degradable Americas Inc. filed a complaint on Nov. 14 in the Fresno County Superior Court against Newstar Fresh Foods LLC and Does 1 through 25 alleging breach of contract.

According to the complaint, on Dec. 4, 2017, and Feb. 23 the plaintiff provided products to the defendant at its request and sent three invoices totaling $110,159.25.

The suit states after entering an agreement regarding the unpaid invoices, the defendant made two payments of roughly $20,000.

The plaintiff holds Newstar Fresh Foods LLC and Does 1 through 25 responsible because the defendant allegedly failed to pay for the products in full.

The plaintiff requests a trial by jury and seeks judgment for damages in the sum of $107,027.98 plus services charges, costs incurred, post-judgment interest, and for such other and further relief as the court may deem just and proper.
