Family of woman killed as result of state Route 41 crash seek damages from driver, vehicle owner

FRESNO – Family members of a woman killed as the result of an auto accident on a state highway are seeking damages from the driver who struck their vehicle.

Blanca Deras; Lourdes Deras; George Deras; et al. filed a complaint on Nov. 14 in the Fresno County Superior Court against Arvind Singh Mahal and Baswinder Kaur Mahal and Does 1 through 50 alleging wrongful death, negligence and negligent infliction of emotional distress.

According to the complaint, on Aug. 4, Blanca Deras was stopped for traffic northbound on state Route 41 Highway, west of Kanan Road with some of the plaintiffs as passengers when Arvind Singh Mahal, driving a truck owned by Baswinder Kaur Mahal, rear-ended the plaintiff's vehicle. The suit states Louise Nunez Deras was "catastrophically injured" and ultimately died from her injuries.

The plaintiffs hold Arvind Singh Mahal and Baswinder Kaur Mahal responsible because the defendants allegedly negligently and recklessly owned, managed, entrusted or controlled the truck so as the cause the incident.

The plaintiffs request a trial by jury and seek judgment for damages, prejudgment interest, costs of suit, and such other and further relief as the court may deem just and proper. They are represented by Spencer R. Lucas of Panish Shea & Boyle LLP in Los Angeles.
