TES Transportation, individuals sued by man who was struck at Fresno intersection

FRESNO – A Los Angeles County man is seeking damages from two individuals and a company after he was struck at a Fresno intersection.

Balijinnyam Mongoljav and Sissi Ganbaatar filed a complaint on Nov. 16 in the Fresno County Superior Court against Altangerel Damba, TES Transportation Inc., Adolfo Hernandez and Does 1-10 alleging negligence.

According to the complaint, on Feb. 9, Damba asked Mongoljav to exit the tractor-trailer owned by TES to help him make a safe turn at a Fresno intersection. Mongoljav alleges while he was assisting Damba, he was struck by a vehicle operated by Hernandez.

The plaintiffs hold Damba, TES Transportation Inc., Hernandez and Does 1-10 responsible because Damba allegedly negligently forced Mongoljav to exit the vehicle and Hernandez allegedly drove at an excessive speed.

The plaintiffs seek judgment against defendants for general damages, medical and incident expenses, loss of earnings, loss of use, loss of consortium, interest, costs of suit. They are represented by Alan F. Gindler of Phoenix Law Firm in Pasadena.
