Pedestrian seeks damages from San Francisco, construction company after falling in hole

SAN FRANCISCO – A pedestrian alleges he was injured when a board covering a hole in a sidewalk gave way and caused him to fall.

Mario Salvador Ruiz Ruano filed a complaint on Nov. 20 in the San Francisco Superior Court against the county of San Francisco, the city of San Francisco, Full Bright Properties LLC and Does 1 through 50 alleging negligence and premises liability.

According to the complaint, on Jan. 20, the plaintiff was walking on the sidewalk on Market Street in San Francisco and fell when a piece of particle board he stepped on that was covering an open hole at Full Bright's construction site gave way. 

The plaintiff holds the county of San Francisco, the city of San Francisco, Full Bright Properties LLC and Does 1 through 50 responsible because the defendants allegedly failed to maintain the sidewalk in a reasonably safe condition and failed to warn the public of the danger.

The plaintiff seeks judgment for general damages, interest, costs of action and any other and further relief that the court considers proper. He is represented by Joseph Nazarian and Giancarlo Irribarren of Rafii & Nazarian LLC in Beverly Hills.
