SAN FRANCISCO – Tenants of a San Francisco property allege that the property's owners failed to repair issues with mold and other problems.
John A. Loufas and Andrew Loufas filed a complaint on Nov. 21 in the San Francisco Superior Court against Douglas Jacuzzi and Georgia D. Hodges over alleged violation of the San Francisco Residential Rent and Stabilization Code.
According to the complaint, on Dec. 21, 1995, Loufas' deceased parents entered into a written residential lease agreement with the defendants' predecessor in interest and moved into the defendants' 43rd Avenue, San Francisco premises. The suit states the plaintiffs moved into the property sometime after 2001 and the defendants became the property's owners in 1999.
The suit states the plaintiffs discovered defects in the property, which include mold and mildew, lack of sufficient heat, water leaks, faulty plumbing and other issues. They allege the defendants were aware of the defects and failed to take reasonable action to bring the premises in accordance with applicable law.
The plaintiffs request a trial by jury and seek judgment for general and special damages, attorney's fees, costs of suit, and such other and further relief as the court deems just and proper.
