Motorist involved in Walnut Creek collision alleges Lyft driver was using phone

SAN FRANCISCO – A motorist alleges a Lyft driver was using a cellphone before a collision in Walnut Creek.

Ali Opeyany filed a complaint on Nov. 21 in the San Francisco Superior Court against Lyft Inc., Nicole Portue and Does 1 to 100, alleging negligence.

According to the complaint, on Aug. 16, 2017, while traveling on Ygnacio Valley Road near the Ygnacio Plaza Shopping Center in Walnut Creek, Opeyany's vehicle was struck by Portue, a Lyft driver. The plaintiff alleges the collision caused injuries.

The plaintiff holds the defendants responsible because defendant Portue allegedly deliberately operated a motor vehicle while on her cellphone in a reckless manner.

The plaintiff seeks judgment for compensatory and punitive damages according to proof. The plaintiff is represented by Williams S. Ginsburg and Diem T. Tran of Berg Injury Lawyers in Sacramento.
