SAN FRANCISCO – Four residents of San Mateo County allege money they paid to a company for remodeling work on their homes was misappropriated.

Robert and Elisha Finney and Edward and Dina Jackson filed a complaint on Nov. 21 in the San Francisco Superior Court against Judith A. Thompson and Does 1-50 alleging fraud, conversion and other counts.

According to the complaint, plaintiffs entered into contracts with Thompson Brooks Inc. for general contracting work on their homes. The suit states Thompson was principal shareholder of Thompson Brooks at the time.

The plaintiffs claim during the course of performance of the remodeling, they made payments for the work but Thompson misappropriated and converted the funds for her own use.

The plaintiffs holds Thompson and Does 1-50 responsible because the defendants allegedly falsely and fraudulently represented to plaintiffs that the monies paid to Thompson Brooks Inc. would be used to fully and faithfully pay subcontractors for work performed at the their residences.

The plaintiffs request a trial by jury and seek judgment for damages, penalties, attorney's fees, interest, costs of suit, and such other and further relief as the court may deem just and proper. They are represented by S. Mitchell Kaplan, Gregory J. Gangitano and Suzanne T. Stafford of Gordon Rees Scully Mansukahni LLP in San Francisco.
